APPLICABILITY

These Terms of Sale apply to your orders, purchases, and returns at UFO Rehab & uforehab.com. These Terms of Sale create a legally binding agreement between you and UFORehab (referred to as “UFORehab,” “we,” “us,” or “our”).

UFORehab may revise these Terms of Sale without notice by posting the revised Terms on www.uforehab.com (Website). The Terms of Sale posted on the Digital Store at the time you place your order will govern that purchase. Please read these Terms of Sale carefully and ensure the details of your order are complete and accurate before submitting it. If you believe there is a mistake, please contact us. UFORehab's Terms of Use and Privacy Policy are incorporated herein by this reference.

Please read these Terms of Sale carefully before ordering products online from the Digital Stores.

Nothing in these Terms of Sale excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by any applicable law which cannot lawfully be excluded or limited. This may include the Australian Consumer Law (ACL) which contains guarantees that protect the purchasers of goods and services in certain circumstances.

 

NO PURCHASE FOR RESALE

Digital Stores are intended solely for UFORehab to sell UFORehab products directly to end consumers, and the purchase of products for resale is strictly prohibited. Purchase for resale means the purchase of UFORehab products by someone who resells, or intends to resell, the UFORehab product to others (consumers, businesses, or any third party). If UFORehab believes you are involved in purchasing for resale, we reserve the right to take action, including but not limited to restricting sales, canceling your orders, or suspending or closing your account.

 

HOW TO MAKE A PURCHASE

To complete your purchase online you must provide your full name, email address, valid delivery address, and payment method to place an online order. You may need to adjust your device settings or enable your browser to accept functional cookies and pop-ups to use all the features of a Digital Store, including adding products to your shopping bag, and submitting your order.

When you submit an order, we will send an email acknowledging receipt of your order (Order Confirmation). Our acceptance of your order takes place when the products are shipped to you, and we will send a second email confirming that the products have been dispatched.

If we are unable to supply a product and we have not processed your order, we will inform you and will not process the order for that product. If we are unable to supply a product, and we have already processed your order, we will notify you and issue a refund.

 

OUR RIGHT TO REJECT YOUR PURCHASE OR CANCEL AN ORDER

Sale of products and fulfillment of orders at a Digital Store is subject to availability and our discretion in managing inventory. Subject to your rights and our obligations under applicable laws, including the ACL, we explicitly reserve the right to limit, decline, or reject any sale or order for any reason (acting reasonably), without being liable for any damage or costs other than repayment of any amount received from you in relation to such sale or order, in situations including but not limited to:

  • An Event Outside Our Control (as defined below);
  • The product you wish to purchase is not available or in stock;
  • Your address, billing information, or form of payment is incorrect or cannot be verified;
  • Your order is flagged by our security systems as potentially fraudulent, or placed with automated ordering software or technology;
  • There is evidence that your order (or cumulative orders) was purchased for resale, tax evasion, or another fraudulent purpose;
  • Your order was flagged for freight forwarding or shipping to an address or service provider that enables or allows foreign export or unlawful avoidance of sales tax;
  • Your account and/or purchase history shows an excessively high volume of returns;

 

PAYMENT METHODS

Our current payment method is via PayPal. You do not need a Paypal account to process payment - you can check out as a guest.

 

The product prices displayed on the Digital Stores are quoted in Australian dollars and inclusive of Goods and Services Tax as applicable. Shipping rates are applied per order. For details on shipping rates, see the Shipping & Delivery section of the Website.

 

The total price specified on the final checkout screen includes shipping costs. This price will be recorded in the Order Confirmation, which we recommend you print or download for future reference. Prices displayed on the Online Store may change from time to time, but changes will not affect any order which we have confirmed in an Order Confirmation.

If your local currency is not in Australian dollars, your bank or credit card issuer will apply the exchange rate and any fees according to the terms and regulations applicable to you and the bank/issuer of your credit or debit card. The exchange rate and any fees applied by the bank/issuer are beyond our control.

 

Please refer to the Shipping & Delivery section of the Website for the available delivery dates, times, and methods. We can only fulfill an order to a delivery address which is a home or office address. Please note, delivery dates and times are estimates only. We do not ship on certain public holidays. There may also be delays in preparing orders during peak periods. Including but not limited to Black Friday sales and Boxing Day sales. We will use all reasonable endeavors to deliver your order in accordance with the relevant delivery date, but we will not be liable for any late or delayed deliveries that are beyond our reasonable control.

 

CANCELLING ORDER BEFORE DELIVERY

You may cancel any order free of charge and without giving us any reason, provided it has not yet been shipped within thirty (30) minutes from the time the order was placed. If you do not cancel an order within the thirty (30) minute window, the product(s) will be delivered to you in accordance with these Terms of Sale. You may then choose to return the product(s) once you receive them in accordance with the return procedure set out below.

 

RETURNING PRODUCTS AFTER PURCHASE/DELIVERY AND REFUNDS

We offer a 30-day return window from the date of delivery for all orders if you change your mind, with some exceptions (set out below). To initiate a return, please visit your Order Portal.  Returns or exchanges made after 30 days will not be accepted, unless the product is faulty or damaged (see below).

For in-store purchases, please contact the store you purchased from directly to arrange a return. Please note that our store returns policies may vary—please contact the store directly if you have questions.

 In-store returns for purchases made via Nike.com or the NIKE App are not available. 

Once your return has been initiated, please follow the instructions that have been provided to you during the returns process and send the items back within 7 days. Returns typically take 7-10 business days to reach us. Once your return is delivered to our warehouse, you’ll receive a confirmation email from our carrier (currently, Australia Post), followed by a notification from us when your refund is issued. Refund processing times vary depending on your payment provider.

UFORehab will cover the cost of return shipping for faulty or damaged items (see below). 

 

PRODUCT CONDITION FOR RETURNS

Other than where products are faulty or damaged, products must be in new, unused condition, with all original protective materials, tags or stickers (if applicable), and in the original packaging. All returns will be subject to quality control checks. Refunds will be processed to the original payment method.

Once your return is confirmed as meeting the conditions of the return policy, we will issue a refund for the price you paid for the returned items (excluding shipping charges where applicable).

 

NON-RETURNABLE ITEMS

Other than where products are faulty or damaged, the following items cannot be returned for change of mind:

  • Worn, washed, or altered items
  • Items without proof of purchase
  • Items missing original protective materials, tags or stickers
  • Items not in their original packaging (e.g. for shoes, not in the original shoe box)
  • Items returned outside the 30-day window
  • Items where the listing indicates that a refund is not available, such as items listed as “Final Sale” or clearance

Additionally, certain products are ineligible for cancellation, withdrawal, or returns (unless they are faulty or damaged), including:

  • Personalized or bespoke items
  • Certain accessories
  • Underwear, nightwear, and swimwear (unless the protective adhesive strip is still intact and the product is in saleable condition)
  • Any items marked as non-refundable at the time of purchase

This does not affect your statutory rights in relation to faulty or damaged products (see below).

 

EXCHANGES

We do not offer exchanges for online orders. To exchange an item, you can place a new order for the item you want and return the unwanted item for a refund in accordance with our Returns Policy.

 

RETURN OF FAULTY OR DAMAGED PRODUCTS

You have statutory rights that entitle you to return products if they are faulty or damaged or otherwise not in conformity with your order. In such cases, the purchase price and any shipping costs will be refunded. For instructions on returning faulty or damaged products, please visit the Returns section on the return policy page.

 

EVENTS OUTSIDE OUR CONTROL

If an Event Outside Our Control affects our ability to perform under these Terms of Sale:

a.     We will make reasonable efforts to contact you as soon as possible to notify you.

b.     Our obligations under these Terms of Sale will be suspended, and the time for performance will be extended for the duration of the Event Outside Our Control.

If the Event Outside Our Control impacts delivery of a product to you, we will arrange a new delivery date once the event is over.  We may cancel your order on your behalf and issue you with a refund if an Event Outside Our Control occurs.
